Terms and Conditions

Definitions:
‘Fletcher Residential ‘us/we/our’
Landlord ‘you’

The terms and conditions relate only to the 'Find a Tenant’ and 'Find a Tenant+' services.

By entering into this agreement you are confirming you have read the terms and conditions, and you agree to them

You agree for us to publish your advert on the www.fletcher-residential.co.uk website and partner sites.

Your responsibilities

You agree you have the legal right to let the property

You agree the description you provide is true and accurate, and is not misleading in any form. We do not take any responsibility for the accuracy of the information or images supplied by you and cannot be liable for any such errors.

You will pay the advertising fee in full, before the advert is published.

You have obtained permission from the owner of any photographs used; We will not be held liable for any breach of copyright.

If you have a contract with another letting agent you are confirming that you have independently checked that contract with regard to the agents future claim for commission in relation to you letting your property on the internet. We will not be liable, if it is later found that you are legally bound to pay another letting agent commission.

Only one property may appear per advert.

You will inform us via email once the property has been let, within five working days.

We will not be liable for any computer virus transmitted through the site. It is your responsibility to use suitable antivirus software.

You fully understand that we do not set the marketing price, conduct viewings (unless you have purchased an accompanied viewings option) or negotiate between you and a potential tenant

You agree to have a current landlord's gas safety certificate and will give to the tenant(s) a copy on or before the start date of the tenancy.

You agree to have a current EPC Energy Performance Certificate in place and will show the tenant(s) a copy on or before the start date of the tenancy.

You agree to have a PAT Portable Appliance Testing system in place as necessary.

You agree to register the tenants deposit, with the Tenant Deposit Scheme or other accredited deposit scheme, and will inform the tenant(s) accordingly.

You have no formal contract with us other than the time period of your advertising term.

You agree to advertise at least one image of the property.

Our responsibilities

We will advertise your property details within two working days on our partner sites, we reserve the right to amend or change your advert and amend or change which partner sites or property portals your advert will appear on.

Any “To let” boards purchased will be dispatched to your property address within three working days.

We will remove from listing all let properties within two working days of receiving notice from you stating the advertised property is let.

All properties will have a maximum advertising coverage of 3 months

We will make every effort to try to ensure that www.fletcher-residential.co.uk is available at all times. We reserve the right to take the site offline for upgrades or essential maintenance. This will be done without prior notice.

We will not disclose your personal details to any third party without your permission, unless we are requested to do so legally. We will only publish the details that you select as part of your advertisement. We reserve the right to email you further promotional and marketing offers

We shall be entitled to suspend any services without notice or liability where you have used the service in an unlawful manner or you have failed to comply with the terms of use and advertisement.

We are entitled to suspend/terminate the services in full at any time, by giving you 24 hours notice.

Limitation of Liability

We will under no circumstances be deemed liable for negligence, breach of contract, loss of data or profit, failure to perform, misrepresentation or otherwise, for a direct or indirect loss or damage suffered by you as a result of use or association with our website or for dealings with any company advertised on or linked to our site.

You agree and fully accept that our liability will under no condition or circumstance ever exceed the advertising fee received.
